Man Claims His Defective Bard Hernia Mesh Had to Be Surgically Removed After Mesh Failure

Ventralex Lawsuit Blames Defective Hernia Mesh Design for Patient’s Severe Complications


Claims continue to pile up against C.R. Bard as more patients discover their hernia mesh failure was accused by defective Bard hernia mesh products. A recent lawsuit filed against the infamous medical device manufacturer alleges that dangerous defects in Veteralex hernia mesh caused a man’s severe complications and need for an invasive revision surgery years after the mesh was implanted.

The complaint, filed last month by James Keaulana and his wife, claims the design of the polypropylene mesh Keaulana received was faulty and created severe health risks for him and other patients. Recent studies have found polypropylene mesh can contract and degrade once implanted inside of the body,. This breakdown of mesh can lead to serious internal injuries and the need for surgery to remove failed mesh.

Keaulana alleges that after receiving Bard’s Veteralex patch mesh during an epigastric hernia repair surgery, his implant degraded and failed, resulting in the need for him to undergo revision surgery eight years later.

“As a result [from his failed hernia mesh product], Plaintiff James K. Keaulana has suffered permanent injuries and significant pain and suffering, emotional distress, lost wages and earning capacity, and diminished quality of life,” the lawsuit states.

Keaulana’s lawsuit blames the design of the Davol Mesh Veteralex patch for causing his severe complications. The Veteralex mesh is made up of dual layers of polypropylene mesh sewn together with polytetrafluorethylene monofilament.

“Despite Defendants’ claims that this material is inert, a substantial body of scientific evidence shows that the mesh material is biologically incompatible with human tissue and promotes an immune response in a large subset of the population receiving the product,” the lawsuit claims. “This immune response promotes degradation and contracture of the polypropylene mesh, as well as the surrounding tissue, and can contribute to the formation of severe adverse reactions to the mesh.”

Bard Hernia Mesh Lawsuit Litigation

Keaulana’s claim, filed in the U.S. District Court for the District of Hawaii, joins over 3,500 similar product liability lawsuits against C.R. Bard. Each of these thousands of cases raise similar claims that Bard’s hernia mesh products caused individuals’ debilitating and often painful complications following hernia repair surgery. Bard products named in these lawsuits include Bard Perfix, Bard Composix, and Bard Ventralex meshes among other polypropylene products.

The Judicial Panel on Multidistrict Litigation (JPML) centralized these claims as part of a federal multidistrict litigation (MDL) in the Southern District of Ohio. One judge currently presides over the Bard MDL and works towards organizing the coordinated discovery and pretrial proceedings for these cases.
