Settlement Announced For Victims Of Stryker ABGII And Rejuvenate Hip Replacements

Fort Worth, Texas, Nov. 6, 2014 — Victims who have suffered from defective Stryker Rejuvenate and ABGII hip implants can rest easier, now that the courts have approved a proposed global settlement. The settlement proposal includes a base award amount of $300,000 to each claimant who has undergone revision surgery on or before to Nov. 2, 2014, and who meets several other criteria.
The Master Settlement Agreement was recently executed by members of both the New Jersey and federal multi-district litigation teams. On Nov. 3, Stryker executed the agreement before Judge Brian Martinotti in Bergen County, N.J. court, at the same time as the settlement was announced before Judge Donovan Frank in Minneapolis, who oversees the nationwide litigation.
“Those who received these defective hip implants have suffered enough, with symptoms that have ranged from unbearable pain to tissue death to bone deterioration,” said Mike McGartland of McGartland Law Firm, who has been appointed to the Plaintiffs Steering Committee for the national litigation effort in Minnesota. “With this settlement, many victims may at last find some relief.”

What Was The Trouble with ABG II and Rejuvenate Hip Implants?
The friction of its metal parts can lead to, according to Stryker, “…a potential for fretting and corrosion at the modular neck junction which may lead to adverse local tissue reactions.” These reactions may include:
- Unbearable Pain
- Necrosis (tissue death)
- Swelling
- Metallosis (buildup of metal debris caused by the grinding of metal parts)
- Dislocation
- Bone deterioration
- Metal toxicity
These products suffer from a very high early failure rate as well, working directly against their original marketed design as a more long-lasting product for younger patients. The patients affected by this defective hip implant required revision surgery to replace the defective hip implant and cease any additional harm that the implant had caused them.
